Lindsay Lohan according to the Los Angeles District Attorney she will not be prosecuted for the theft of the 100,000 dollars’ worth of watches and sunglasses stolen, that the case has been rejected.

TMZ reports:  According to the D.A.’s charge evaluation worksheet, there is insufficient evidence to bring a burglary charge against the actress.

According to the D.A., Lindsay and Sam Magid — the rich guy who owns the house that was allegedly burglarized — have had a “longstanding relationship.”

The D.A. claims Sam did not identify Lindsay as a suspect and the “potential eyewitnesses have refused to become involved.”

Additionally, none of the suspects were found in possession of the stolen property.

Lindsay’s assistant Gavin Doyle will also not face prosecution.

Lindsay Lohan is now being looked at as an official suspect regarding the theft of watches and sunglasses worth 100,000 dollars.

TMZ reports: As TMZ first reported, Lindsay was at the Hollywood Hills home of Sam Magid a week ago when Sam called the LAPD and reported a jewelry theft.   We’re told Lindsay has been at the house frequently, including at an all-night house party a week ago Sunday.

Law enforcement sources tell us … Lindsay and her assistant Gavin Doyle are both suspects in the theft.

Now here’s the twist … We’re told Sam has recanted his story and now says nothing was stolen.  But our sources say cops are not closing out the investigation because they believe they have independent witnesses who can finger Lindsay and Gavin as the thieves.

Sources tell us … LAPD detectives contacted the lawyer for Lindsay and Gavin today, asking for an interview with the two suspects but the lawyer rejected the request.

It’s unclear why Sam — who is insanely wealthy — suddenly changed his tune.

One final thing … This is really bad news for Lindsay, because she’s on probation for the theft case involving the necklace at a Venice jewelry store.  She could go to jail if she violates probation by stealing more jewelry.

Lindsay Lohan has decided to get away all of the drama in Los Angeles, on Tuesday, August 21^st when she caught a flight out!

TMZ reports: We’re told Lindsay is bound for New York — where her mother Dina lives. It’s unclear what she has planned in the Big Apple.

As we reported, Lindsay was interviewed by police yesterday following an all-night party in a Hollywood Hills mansion — during which several expensive watches and sunglasses allegedly went missing.

Lindsay told police she had nothing to do with any stolen property — but the house owner believes she invited the burglars into the home.

Lindsay Lohan has decided to take her brother Cody out on a surfer’s shopping spree where she splurges almost 3,000 on him.

TMZ reports: Lindsay Lohan‘s back to her old ways — at least in the reckless spending department … because TMZ has learned, she recently dropped nearly $3,000 on a surf-themed shopping spree in O.C.

Lindsay and her bro Cody hit up the famous Jack’s surf shop in Huntington Beach Friday — and according to the receipt, the actress spent a total of $2,723 on surfer swag for her brother … and that was WITH a 30% famous-person discount.
We’re told Cody’s an aspiring surfer — and Lindsay wants to encourage him as much as possible by kitting him out.

But the $2,700 bill is just a drop in the bucket for Lindsay — TMZ broke the story … she’s rolling in dough this year, raking in more than $2 MILLION
