James Holmes the notorious mass killer of “The Dark Knight” shooting, his Lawyers have stated that they believe that their client is suffering from a mental illness, and they also cannot figure out his plea till they figure out what’s wrong with James.

TMZ reports: Holmes’ attorneys made the announcement during a hearing today, in which several news outlets had assembled to argue that the judge in the case should unseal court documents that could reveal important details about the July shooting in Aurora, CO.

Both the prosecution and the defense wish to keep the documents under wraps while the case is pending.

While everyone was in court, Holmes’ attorney also appealed to the judge on an unrelated note — demanding prosecutors and investigators turn over ALL documents related to the case … in order to help the defense team determine just how crazy their client is.

The lawyer said, ”We cannot begin to assess the nature and the depth of Mr. Holmes’ mental illness until we receive full disclosure of all the documents.”

It’s the first mention of Holmes’ intent to pursue an insanity defense.

A victim of the horrifying massacre at the “Dark Knight” in Colorado, is stating that James Holmes deserves to be suffering in prison to be sentenced the death penalty.

TMZ reports: TMZ spoke with Steven Hernandez … whose sister Rebecca Wingo was shot and killed, along with 11 other people, during the midnight screening of “The Dark Knight Rises” earlier this month.

32-year-old Wingo leaves behind two young daughters.

Prosecutors say they will consider pursuing the death penalty for Holmes — but will not make a decision until they speak with the families of the victims.

Hernandez has already made up his mind — explaining, “My sister Rebecca was killed in the theater. My mother is bereft, my wife is distraught and I am heartsick and angry.”

“Allow the justice system to punish this murderer. I want to see him sentenced to death and I hope he sits in jail many years waiting to die.”

Holmes has been charged with 142 counts for the shooting — including 24 counts of 1st degree murder.

James Holmes that decided to go on the rampage killing 12 people at the Colorado theater, and now the theater is stepping in and offering to pay the funeral expenses.

TMZ reports: Several funerals were held Friday in Aurora, Colorado — one of them for Rebecca Wingo … a 32-year-old mother of 2.

Sources close to Rebecca’s mother tell TMZ, Cinemark — corporate owners of the Century 16 Theater — called the chapel where Rebecca’s service was held … and offered to foot the bill for her funeral.

In fact, the owner of the chapel says Cinemark told him it was willing to provide financial backing to all victims’ families — by paying any funeral expenses not covered by the Crime Victims’ Compensation Fund.

Rebecca’s mother, Shirley Wygal, turned down the offer and through a spokesperson told TMZ, the reason was that the Victims Advocate Fund paid for everyone’s main funeral expenses.

The spokesperson told us, “Ms. Wygal is extremely grateful for all those who continue to donate to their family through a memorial fund and Rebecca’s two little girls left behind college fund via the families website at AuroraHeroes.com which is not only made for Rebecca, but for all the victims of the tragedy … Any and all additional funds will be transferred to the two little girls of Rebecca’s college fund.”

It’s unclear how many funeral homes and chapels in Aurora got the same call. Cinemark hasn’t returned our call for comment yet.

James Holmes shot 70 people in a Colorado movie theater and after finding out that he was signed up with two adult sex websites, he was turned down by three women.

TMZ reports: We broke the story … Holmes was an active member on AdultFriendFinder.com … and now we’ve learned he reached out to multiple women before the movie theater attack.

TMZ spoke with three women who were contacted by Holmes since he opened his account on July 5  … and each of the women tell us they turned down the killer’s requests to meet up.

One of the women tells us … Holmes wasn’t aggressively seeking out sex — in fact, she says he was “just looking to maybe chat … nothing sexual.”

The woman told us she rejected Holmes because she just wasn’t into him.

Despite his innocent approach, Holmes made it clear on his profile he wasn’t just looking for a friend — in fact, he described himself as a guy looking for a “casual sex girl” and possibly group sex.

Holmes’ profile has since been removed from the site.

James Holmes days before he decided to kill 12 people, he signed up for an adult site, and described himself as single and average.

TMZ reports:

A man claiming to be James Holmes created a profile on a popular sex website just days before “The Dark Knight Rises” massacre … in which he described his penis as “short/average” … and law enforcement sources tell TMZ investigators are now looking at the site to determine its authenticity.

“Holmes” created the profile on AdultFriendFinder.com July 5 — and included a picture of himself with reddish, orange hair … just as officials in Aurora, CO said he looked when he was apprehended Friday morning.

“Holmes” — who used the screen name classicjimbo — included a cryptic message on the top of the profile which reads, “Will you visit me in prison?”

In his profile, “Holmes” says he’s 6’0″ and single … with an athletic body.   Note — the FBI says Holmes is 6’3″.“Holmes” describes himself as a “light/social drinker” … but in the section where he’s asked if he smokes or does drugs, he answered, “I’d prefer not to say.”

“Holmes” also noted that he’s circumcised.

“Holmes” described himself as a straight man … and said he was seeking a sexual relationship with “Women, Couples (man and woman), Groups or Couples (2 women).”

“Holmes” also notes that he’s interested in “Erotic Chat or Email, Discreet Relationship, 1-on-1 sex or Group sex (3 or more!)”

In the section marked, “Introduction” … “Holmes” said, “Looking for a fling or casual sex gal. Am a nice guy. Well, as nice enough of a guy who does these sort of shenanigans.”

According to the website, “Holmes” last logged in to the site sometime in the past 3 days.

“Holmes” posted 2 different photos of himself — including one shot in which he is posed in front of an image of a woman while wearing headphones.

If it turns out that it is indeed Holmes’ profile, the information could be relevant in the investigation.
